When the deceased bought off-plan and the building is not yet complete, there is no title deed to transfer — there is a position on DLD’s interim register, held under a preliminary sale agreement with the developer. Where a preliminary sale agreement exists, the developer’s no-objection letter is required exactly as a bank’s is for a mortgage. Developers check their own ledgers before issuing it: instalments due under the payment plan, and service-charge or community levies where already invoiced. Arrears block the clearance exactly as they do in a sale — obtain the developer’s statement of account early and settle what is outstanding before the file goes in.
The heirs take the contractual position whole: the paid instalments stand to their credit, the remaining schedule becomes theirs to perform, and the agreement’s terms continue unchanged. On completion and handover, the final title deed issues in the heirs’ names through the standard first-registration process. An inherited off-plan position can also be sold onward before completion — that is an assignment under the developer’s rules, and it, too, happens only after the inheritance transfer has put the heirs on the interim register.
